I am advised by the Law Officers with re-
gard to the disposal of the Murray Battery site, which was
not purchased and paid for by the Imperial Government and
is no
longer required for military purposes, and of which
the retention is not desired by the Colonial Government
that the procedure in accordance with the Colonial Office
Circulars of 1890 and 1894 on the Disposal of Colonial
Military Lands, is for the War Department to surrender the
site to the Colonial Government, for that Government to
#ell the lease in the usual way and for the usual term of
75 years and for the proceeds of the sale to be placed to
the credit of the War Department in the Military Lands
Account.

I am further advised that in the case of
the Spring Gardens property of which the unexpired portion
of a 999 years lease was purchased by the War Department
in 1857 from a Crown Lessee for the sum of $25,000 and
which was expressly exempted in 1859 from Crown rent while
it remained the property of the War Department, that De-
partment can dispose of the remainder of the lease to pri-
vate persons subject to the re-imposition of Crown rent.
